Guests visiting the WACA Ground should be aware of the Terms & Conditions policy.

1. BOOKING OF FUNCTION FACILITIES AT THE WACA GROUND
- 1.1. Bookings of function facilities at the WACA Ground are made by submitting this agreement to the Western Australian Cricket Association.
- 1.2. Submission of this agreement to the Western Australian Cricket Association binds you to the terms of this agreement in its entirety.
2. FINAL NUMBERS AND DETAILS
- 2.1. Estimated guest numbers are required to be provided at the time of deposit.
- 2.2. Confirmed guest numbers are due in writing, 7 days prior to the function date (or at the time of deposit, if the booking is made less than 7 days prior to the function date).
- 2.3. Confirmed guest numbers may not be decreased less than 7 days prior to the function date. If the confirmed guest numbers decrease for any reason after this deadline, the client authorises the Western Australian Cricket Association to charge for the confirmed guest numbers as recorded 7 days prior to the function date.
- 2.4. If no confirmed guest numbers are received in writing 7 days prior to the function date as required under clause 2.2, the client authorises the Western Australian Cricket Association to charge for the estimated guest number given when the function was booked as per clause 2.1.
- 2.5. If the client wishes to increase the confirmed guest numbers less than 7 days prior to the function date, this will be subject to approval in writing by the Western Australian Cricket Association. If written approval is granted, the client authorises the Western Australian Cricket Association to charge for the additional guests, even if the final guest numbers then decrease.
3. PAYMENT & PRICE VARIATIONS
- 3.1. A 25% deposit or $1,500 (whichever is the higher) is required to confirm the booking, payable either by credit card, electronic funds transfer or cheque. Bank account details for the purposes of facilitating an electronic funds transfer are available from the Western Australian Cricket Association. On receipt of this agreement and your payment details, you will be issued with a tax invoice recording necessary details.
- 3.2. Full payment must be received by the Western Australian Cricket Association at least 7 days prior to the function, with reference, remittance, or cheque number advised in writing within this timeframe.
- 3.3. If the client wishes to pay by electronic funds transfer, the client must notify the Western Australian Cricket Association as such and send a remittance slip indicating payment no more than 24 hours after receipt of invoice. If the Western Australian Cricket Association does not receive a remittance slip in this timeframe the client authorises the Western Australian Cricket Association to charge the credit card for the invoiced amount.
- 3.4. Credit card details must be provided at the time of booking. The client authorises the credit card to be charged for any unpaid amounts relevant to the booking that have not been paid by the required time. An invoice will be raised by the Western Australian Cricket Association simultaneously with any credit card being charged.
3.5. All payments made by credit card will attract the following surcharge plus:
+ 1.5% of the invoice total – VISA, MasterCard and AMEX - 3.6. Prices may vary from original quotations in cases where cost increases are incurred, or additional services are requested subsequent to the quotation being made. Upon any such variations becoming known, details of the same will be supplied to you and any additional payment required will be payable within 7 business days of such details being given to you.
- 3.7. Unless full payment is received, the Western Australian Cricket Association is under no obligation to proceed with the booking.
4. CANCELLATION BY CLIENT
- 4.1. All cancellations must be made in writing and at the discretion of Western Australian Cricket Association will incur the following charges.
- 4.2. If cancellation occurs more than 3 months prior of the event, the cancellation fee will consist of the total deposit paid.
- 4.3. If cancellation occurs within 3 months of the event to 1 month prior, the cancellation fee will consist of the total deposit plus 50% of the initial quote provided.
- 4.4. If cancellation occurs within 1 month of the event to 14 days prior, the cancellation fee will consist of the total deposit plus 75% of the initial quote provided.
- 4.5. If cancellation occurs within 14 days of the event, the cancellation fee will consist of the total deposit plus 100% of the projected initial quote provided.
- 4.6. In addition to the cancellation charge, the client will be liable for any cancellation fees incurred by the venue for services contracted and/or deposited on your behalf, where the venue and/or third party supplier applies a cancellation fee.
5. CANCELLATION BY WESTERN AUSTRALIAN CRICKET ASSOCIATION
- 5.1. Western Australian Cricket Association may cancel this agreement or at its discretion offer alternative dates or venues without notice if:
- 5.2. The venue is unfit for use or other reasonable cause; or you are in breach of any provision of this agreement.
- 5.3. Where the Western Australian Cricket Association cancels this agreement for reasons other than those set down in clause 5.2, the Western Australian Cricket Association may refund the function charges in part or in full at Western Australian Cricket Association absolute discretion.
- 5.4. The Western Australian Cricket Association will not be liable for any loss or damage arising out of the cancellation of this agreement pursuant to this clause.
- 5.5. If the Western Australian Cricket Association proposes to carry out a redevelopment of any part of the WACA Ground then:
- 5.5.1. Notice will be given to the client as soon as a development date is identified and the impact to the client (if any);
- 5.5.2. If no impact the function or event will proceed as agreed;
- 5.5.3. If the development impacts the client’s function or event, the Western Australian Cricket Association will reschedule the date or refund any deposits or money paid in consultation with the client.
6. SURCHARGES
- 6.1. The client agrees to begin the function and vacate the designated function space at the scheduled times agreed. In the event a function should go beyond the agreed finishing time, the venue reserves the right to impose a labour charge for each hour and part hour that the function space is occupied. These charges are at the direction of the Western Australian Cricket Association.
7. INSURANCE & INDEMNITY
- 7.1. The Western Australian Cricket Association will take all necessary care, but accepts no responsibility for the damage or loss of items or any personal injury suffered by any person before, during or after a function. It is your responsibility to arrange your own insurance cover for property and equipment damage and public liability.
- 7.2. You indemnify the Western Australian Cricket Association against any loss or property damage to the premises arising out of your use thereof during the period of this agreement and for any personal injury, death or loss of or damage to any property or any person arising out of or as a consequence of your use of the premises or services except that such loss, damage, injury or death arises from the negligent act or omission of the Western Australian Cricket Association.
- 7.3. You are responsible for all rectification costs required to the venue or replacement costs of damaged property save for any right to contribution to those costs arising from loss and damage that is attributable to negligence on the part of the Western Australian Cricket Association. If any part of the venue is damaged as a result of your use during the event, The Western Australian Cricket Association will immediately notify you of such damage together with details of damage and a quote within ten days from completion of the event. You will pay the agreed reasonable costs of rectifying such damage within thirty days of receipt of a tax invoice.
- 7.4. If you fail to reimburse the Western Australian Cricket Association for any such damage or loss the Western Australian Cricket Association is entitled to recover such loss a liquidated debt from you. The production of an invoice or invoices for the rectification works or replacement of property is agreed proof of the minimum amount required to rectify such damage or loss.
8. PREVENTION OF DAMAGE
- 8.1. You will be held responsible and agree to indemnify the Western Australian Cricket Association for any damage sustained to the venue, whether by the actions of your guests or your own personnel. Staples, nails, fasteners, adhesive decals or posters must not be applied to any surface without the approval of the Event Coordinator prior to the event. Fines may be imposed for any unauthorized access of the WACA Ground field. In the event such fine remains unpaid by the offending function patron for a period exceeding 28 days, you will indemnify the Western Australian Cricket Association for the fine.
9. CONDITION OF ENTRY
- 9.1. The following conditions of entry apply to all visitors and attendee’s (Patrons) attending the WACA Ground.
10. LIQUOR LICENSING
- 10.1. All guests are subject to the Western Australian Cricket Associations Harm Minimalisation Policy.
- 10.2. Due to licensing laws, beverages are not to be brought onto or taken off the premises by any party.
- 10.3. Beverage service is to cease as per the functions scheduled timings.
- 10.4. Functions with alcohol service may require security; this service will be charged at commercial rates and is at the discretion of the Western Australian Cricket Association.
11. PARKING
- 11.1. No dedicated car parking exists unless pre-arranged with the Event Coordinator, guests will need to make their own parking arrangements.
12. SECURITY
- 12.1. The WACA Ground is monitored 24 hours a day by CCTV cameras. Additional security staff may be required for your function and will be charged at commercial rates. These charges are at the direction of the Western Australian Cricket Association.
13. FIRE SAFETY/SMOKING
The WACA Ground is a non smoking venue. The following terms must be adhered to without exception:
- 13.1. All fire exits and public entrances must not be obstructed at any time;
- 13.2. Combustible items or ignition sources are restricted from being placed inside the premises;
- 13.3. Any materials such as flags, banners, promotional materials must be flame retardant;
- 13.4. No egress widths can be obstructed partly or completely;
- 13.5. No covering of extraction or pressurisation vents;
- 13.6. No fire detection systems can be isolated during occupation;
- 13.7. No temporary infrastructure can obstruct a fire appliance from approaching the building; and
- 13.8. Any temporary infrastructure in the foyer must be adequately resourced to break down in an emergency.
14. RESPONSIBILITY
- 14.1. You will conduct your function in an orderly manner in full compliance with the law, policies, procedures and directions of the Western Australian Cricket Association.
15. WESTERN AUSTRALIAN CRICKET ASSOCIATION MAILING LIST
- 15.1. I have read the terms of the Australian Cricket Privacy Policy and Collection Statement and agree to opt-in to the Western Australian Cricket Association mailing list.
